Although he was often misunderstood, he is really a good man at heart. Having known him for a long time, here's what I expect to read in Lim's diary, which I found underneath a tree. Dear Diary, I have mixed feelings today as I sit down by my lonesome and scribble some thoughts about life in general and the sport we love the most -- basketball. Believe me, I'm happy to finally get my like back. Happy to be a free man again after spending some time behind bars in Bicutan in the company of what they call foreign misfits in the society. What does the old song say? Andy Williams' Academy Award-winning "Born Free?' Well, "No walls divide you and life is worth living but only worth living cause you're born free." I sing that song almost every day now, man.. But heck, I'm bored to death to be out of the basketball circle for a long time now. Without basketball, life is far less entertaining as I thought it would be. After all, basketball is my whole life. It's been almost three years since they forcibly spell the death of our dearly beloved Basketball Association of the Philippines (BAP), the 74-year-old institution founded by some of the revered names in the sport such as the late Sen. Ambrosio Padilla and Lito Puyat. It's been also almost three years since they replaced the BAP with a new association which they want us genuine basketball lovers to call as Samahang Basketbol ng Pilipinas (SBP). Which brings me to an old saying, "What's in a name, really?" A lot, as these self-proclaimed basketball gods would say. Well, my diary, there's simply too many questions hovering around my head as I write this.. What have they done to my favorite game since I've been away? What did they do to raise the level of basketball in the country in the past three years they're in power? What have they accomplished with all those obscene amount of money they so generously spent to players, foreign coaches, foreign trips, and most especially to basketball officials? Frankly, I nearly choked upon reading on my favorite newspaper the results of the recent 16h Asian Games basketball competition where our beloved Team Pilipinas finished only sixth in Guangzhou, China. No, you don't need to remind me it's the second-worst finish by the Filipinos in the quadrennial meet. I nearly wept when I heard again on the radio the saddening news about our team's setback to Qatar. I shuddered as my sportswriter-friends who covered the game live in Guangzhou narrated how the Rajko Toroman-mentored national team scored only seven points in the payoff period against the Qataris' 21 points. I felt a tinge of sadness to think how supposedly one of the better-trained, better-prepared, better-financed national team could play so badly in a game which means the whole world to all of us. Am I surprised that nothing really change much the past three years? Of course, not. With the people now running the sport, there's no surprise we're back to square one. Is this as good as it gets? I'm telling you, I've never seen basketball this bad since they abandoned ship to form the PBA, Asia's first play-for-pay league, in 1975. Do you think I'm happy with what's happening right now? No. Do you think I'm willing to beg the basketball gods and give me a chance to correct the flaws, right the wrong? No. Do you think I'm willing to take the trouble again and seek an audience with the FIBA to restore order and bring about a change in the sport the same way P-Noy is charting a new direction for the country? Maybe. The only ones more depressed than me right now are the same officials who thought they can buy success overnight. Not only did they fail to form a winning team out of the millions they spent from their pockets, but now they have to go back to the tried and tested formula of knocking on the doors of the pro league to get the best players to represent the country. Three years in power and nothing to show but promises? Oh, come on. I tell you now, dear diary, even during my darkest days in prison and life doesn't seem worth living, I still think about basketball instead of playing chess with NCFP head Butch Pichay. Lim Dear Mr. Borislav Stankovic, As I continue to seek the truth and justice for the Basketball Association of the Philippines (BAP), I am always reminded over the way the FIBA secretariat manipulated and conspired to eliminate the BAP (FIBA member since 1936) out of FIBA family. It is inexcusable on your part since that the BAP had been in the frontline in the battle against corruption and greediness among the top officials in the FIBA organization. To be blunt, the people that run the FIBA Secretariat do not command any respect. They lack dignity, at the least. All we know here in the Philippines is that you and your cohorts conspired with the equally corrupt SBP to eliminate the BAP for marketing considerations. This was how the FIBA Asia remarked on you guys. For this year's Yuletide season, I wish that the Holy Spirit would guide you and you would mend your crooked ways and repent. Enjoy the Christmas holidays, and please pray hard for enlightenment. Be merry but keep in mind that I will always be out there to watch your actions regarding the Philippine basketball leadership. The FIBA has had a great tradition but because of the racists (are Patrick Baumann and Bob Elphinston also listening?), conspirators and manipulators in your midst, the image of the basketball organization has been greatly damaged. Attached are two previous correspondence that I sent you during the time when you and your cohorts conspired to kick the BAP out of the FIBA family in collaboration with the inutile SBP. Letter to Mr. Stankovic on December 27, 2008………. If there is some decency left in them, Patrick (Baumann) and Bob (Elphinston) should consider resignation from the FIBA family for their incompetence and racist attitude toward the Chinese and other Asian people. Long before I personally beg to Baumann's compassion to lift the suspension on the BAP but was ignored without any conscience. Letter to Mr. Stankovic on June 7, 2010……….. You used the FIBA Central Board Meeting on March 2-3, 2007 in Madrid, Spain to affirm the recognition of SBP, your equally corrupt conspirator and manipulator. The truth is your racist disciple Patrick Baumann forced the Basketball Association of the Philippines (BAP) in compromise with the SBP and come up with a BAP-SBP merger through the Bangkok Agreement signed on February 4, 2007. As the curse continues to haunt you, Bob & Patrick, I only hope three of you will repent at the soonest time. Otherwise, you will continue to face the wrath of basketball-loving Filipinos. Since it was you who responsible for the merger through the infamous Bangkok Agreement that was incessantly disrespected and violated. I urge you to re-study the agreement since your subsequent actuations have verified the good name of the BAP, which has been in good standing with the FIBA family since 1936. Obviously, you called for the merger to accommodate the entry of the wealthy but fledgling SBP organization and the abolition of the tradition-steeped BAP. Additionally, I would like to address this issue of autonomy. It’s agreed that the FIBA is composed of FIBA-Asia, FIBA-Europe, FIBA-Africa, FIBA-America, and FIBA-Oceania. As such, each continental region is governed by its own rules and regulations. I respectfully state that the FIBA Sub-Zones (or continental zones) are autonomous in nature and have a life of their own. Therefore, utmost respect and dignity must be accorded to all the FIBA members within their continents. The fate of the Basketball Association of the Philippines (BAP) was unjustly sealed when you disregarded the authority and decision powers of FIBA-Asia by not honouring an approved resolution by FIBA Asia to lift the BAP’s suspension in June 2006. Such unilateral action is an unwelcomed encroachment on a matter or issue that is purely internal and must be settled only among FIBA-Asia members. I am deeply concerned that your one-sided decisions (favouring the SBP every turn of the way in exchange for marketing and other considerations) have severely tainted the credibility and integrity of the FIBA as a whole. Sad to say, you have placed the FIBA in a bad light. Rest assured that the BAP will exhaust all legal means to rectify the damage you have inflicted on the institution during your watch. For that matter, FIBA-Asia will act accordingly on the Bangkok Agreement scandal and will not be cowed into submission simply to give in to your caprice and hidden agenda. I only wish that you re-visit and study once again the issues contained in the Bangkok Agreement. Unless the violations are rectified, the issue of which group has the rightful claim to the basketball leadership in the Philippines will remain in doubt. Again, I reiterate that FIBA Sub-Zones (or Continental Zones) are autonomous in nature. Their independence must be respected by the FIBA Secretariat, specifically your office, at all times. Literal, former President of the Basketball Association of the Philippines (BAP), passed away last Tuesday night (September 6, 2010) at the age of 77. Simply known as “Tiny”, Mr. Literal served as president of BAP from January 2001 up to 2005 when he was replaced by former senator Joey Lina due to his health problems. Senator Joey Lina took over at the height of the Philippine Olympic Committee (POC) leadership who instigated to expel the BAP as a member of POC family, unfortunately, that led to the illegal suspension of the BAP from FIBA secretariat. Born on April 13, 1933 in Dipolog City, Zamboanga del Norte, Mr. Literal has six children - Arlene, Vincent, Maita, Roy, Maan, and Paul. Mr. Literal is survived by his wife Febes Dalman Literal. His remains lie at Funenaria Paz at Manila Memorial Park in Sucat, Paranaque. Interment is set on September 14, 2010. Mr. Literal was a former national player who saw action in Taipei in 60’s. He was inducted by Ateneo de Manila University Alumni Association president Ramon O. Cojuangco Jr. into the Ateneo Hall of Fame in December 2000 for his contribution to Ateneo varsity team during the NCAA in the 50’s and won the first post-war NCAA champion for Ateneo in 1953. Former FIBA president and BAP Chairman Emeritus Gonzalo “Lito” Puyat led BAP officials in paying tribute to Mr. Literal. “We will surely miss him,” said the BAP in a statement. “We may not always been together but our heart remains with the sorrow of the family which was left.” Aside from Mr. Puyat, the other BAP officials condoled with Mr. Literal’s family include BAP Chairman, Congressman Luis R. Villafuerte; BAP president Prospero “Butch” Pichay; former BAP president and Athletics chief Mr. Go Teng Kok; Joey Lina; Christian Tan; Tony Fabico; Robert Milton Calo; Miss Tisha Abundo; Red Dumuk; Graham Lim; Bonifacio Alentajan; Wilson Young; Johny Tam; Lito Alvarez; Gil Reglo; Leonardo Andres; Manuel Gatchalian, Coach David Zamar and many more. Among the highlights of Mr. Literal’s term as BAP president came in June 2003, when he led the BAP officials in signing a landmark memorandum of agreement (picture attached, img012) with the Department of Interior & Local Government (DILG), then headed by Secretary Joey Lina. The MOA made the BAP and the DILG as partners in the development of local basketball in the country. When I heard those stories about the Unity Congress held on February 5, 2007, supposedly to bring together the Basketball Association of the Philippines (BAP) and Samahang Basketbol ng Pilipinas (SBP), I could not avoid bursting into laughter for the alleged merger was simply a deception engineered by the FIBA. To me, it was an affirmation that the Philippine sports, like its society in general, is plagued with graft and irregularities. The FIBA, in conspiracy with the SBP, violated the conditions listed in the infamous Bangkok Agreement that was signed on February 4, 2007 in Thailand. To think that FIBA secretary-general Mr. Patrick Baumann even witnessed the signing of the document that purportedly was to unite the two opposing parties for the leadership in the local basketball federation. Mr. Baumann personally attended the Unity Congress in the belief that he had become the saviour of Philippine basketball after signing of the Bangkok Agreement and the subsequent lifting of the country’s suspension from international competitions. How wrong had Mr. Baumann been! On the contrary, they are saying that it was Mr. Baumann who destroyed Philippine basketball after having earlier suspended the BAP without any justification and doing so in consensus with the Philippine Olympic Committee. While the Philippines is now able to eligible to participate in FIBA organized tournaments such as the Southeast Asia Games, FIBA Asia, World Championship and Olympic Games, the SBP, which gained recognition from the FIBA (a violation since the Bangkok Agreement says the organization has be called “BAP-SBP”), continues to be hounded by alleged shady deals and irregular practices. Mr. Baumann reportedly has been the beneficiary of the SBP’s generosity. If only Mr. Baumann knows that he has become a butt of jokes by the SBP officials. In one gathering among friendly sportswriters, top SBP officials claimed that the Mr. Baumann can easily be bought for a few dollars. They said the SBP has the balls of Mr. Baumann tied to its (SBP) strings. “What the SBP wants, it always gets,” boasted the SBP insider, who also revealed that Mr. Baumann was given a few thousand dollars by his group as a token for his personal appearance and travelling expenses during the Unity Congress in Dusit Hotel in Makati City. “The FIBA has been our silent partner from the start. It protects our interests. The SBP leader’s vast business companies so impresses Mr. Baumann. Monetary considerations can really move mountains and we have Mr. Baumann on the palm of our hands.” Wonder no more why the SBP is untouchable. The FIBA is beholden to the SBP group even if the Bangkok Agreement that was initiated by Mr. Baumann was not pursued and later ignored. Mr. Baumann even informed the FIBA Central Board that the Bangkok Agreement was not violated in its desire to protect the interests of the SBP, his pet his creation in the Philippines. The SBP had been magnificent in fooling the BAP. On the other hand, the BAP had followed faithfully the Bangkok Agreement to the letter in the belief the SBP and its spokesman, Mr. Baumann were sincere and men of honour. It turned out they were not. Following a one-year transitory period in 2008, a majority of the voting members validated by the Bangkok Agreement held an election called by the BAP-SBP chair, Congressman Luis Villafuerte in June 2008. Mr. Baumann, however, chose to ignore the results. Instead he recognized the winners of the illegal election called by the SBP just a week after Cong. Villafuerte’s election which same in June 2008 even though the group only had 19 members/stakeholders in its fold. The SBP even voted in six non-members to complete a 25-man Board. How much respect does the SBP have for the FIBA? "The SBP has the ability to turns lies into truths. We can control people from the media, government officials and even those from the judiciary because of our resources. Why then should we be afraid of the FIBA? They are just as corrupt. he...he...he...!" One of our major daily newspapers headlined a sports item that quoted another SBP executive as saying “FIBA is not as clean as what you think.” And yet, the FIBA of Mr. Baumann, even if it has been backstabbed by this SBP executive with the aforementioned article, surprisingly continues to support the group for various considerations. At one time, the SBP even came out with a full-page advertisement in the national major dailies to declare that it would defy the FIBA’s call for a special commission and condemned the FIBA investigation. For this writer to hear this SBP executive describing Mr. Baumann and the FIBA as “fools” was very amusing. Mr. Baumann has discredited its nobility of the FIBA as an IOC Member. It’s really up to the BAP, which has been a FIBA member since the Berlin Olympic in 1936, to seek redress in the proper forum. Certainly, it won’t be in the Court of Arbitration for Sport (CAS), which the SBP has managed to manipulate through its wealth and connection, the hiring of a major law firm in Switzerland, and its mutual understanding with the FIBA through Mr. Baumann. According to the BAP, it only wants the Bangkok Agreement simply honoured. However, the SBP has the resources to control the outcome. Is that asking too much from Mr. Baumann, who is perceived to be the Mr. FIBA himself? One would say that in the Philippines, practically, the SBP are notorious and much to say, we control everything, ha ha ha!, media, judicial, what most important weapon was the SBP has money and can easily get away with anything, you see, that is why we control FIBA too. Ha Ha Ha! Now it is up to the BAP to find a solid stand in the FIBA circle to question Mr. Baumann integrity and his accepting dirty money and if Mr. Baumann think he was clean, one of the SBP close to the top, confidently loudly that Mr. Baumann can’t even do anything, Mr. Baumann will just sit tied and never do anything as what the BAP has been illegally removed as FIBA member, this was a successful effort. All finger point to SBP boys brilliant manoeuvring and simply clean with dirty execution. Hep Hep, Horay! Now look who is crying, the BAP even they have the majority until today, who cares, FIBA can’t even distinguish themselves was is right or wrong, FIBA is just easily to be run around, as one of the SBP inner circle shower with great achievement. Hep Hep, Horay! April 18, 2010 To: The Secretary General, Court of Arbitration for Sport (CAS) Dear Mr. Mattheiu Reeb, Good day! I write you in behalf of the Basketball Association of the Philippines (BAP) regarding our case filed with the CAS Panel against the International Basketball Federation (FIBA) and his associate, Samahang basketbol ng Pilipinas (SBP), that a decision was released but not to the BAP but to our opponent SBP who has said that since last week, they had already the decision in hand while we in the BAP strugglers to look for an answer on how and what happen to our case with the CAS? Last March 30, 2010 we paid our dues to CAS final fee of 2,500 Swiss Franc for the release of the result to us, but it saddened us until today we got no information at all and we were surprised to see in our national dailies newspaper that we lost in our fight against the manipulating FIBA Secretariat in connivance with SBP, their future beneficiary. In the name of God and justice, this has proven a wide spread of wrong approach, I would like to ask why until today the BAP was not provided copy of the decision? We have put our faith and trust to CAS to seek justice. We want to know how the CAS panel did the decision not to recognize the BAP. For sure I will make my personal comment upon reading the decision. In my personal view, primarily, I had memorized the chronological event and easily to understand if our case with the CAS has been manipulated and influenced by FIBA in conniving with the SBP as the benefactor of providing the funds. Based on credential, I have great respect to German Prof. Vedder Christoph who was a professor of Sports Law from the University of Augsburg, but the other two panels which I don’t know much about them. I don’t think Prof. Christoph would make such inconsistence decision and destroy his integrity. Secondly, the outcome of the decision is easy to understand if there was a runaway panel. Even it was a clear evident that SBP has provided the CAS panel two “Minute of Meetings” of the first Unity Congress between the BAP and the SBP where Patrick Baumann was present, one of the items stated that an election was held at 12 pm. which was the original version given to us being circulated dated February 5, 2007. Suddenly it came out when SBP filed response to the CAS late last year only (more than two years) that additional “Minute of Meetings” on same date that an election was also held at 11 a.m., this was a clear intention to manipulation the CAS investigation through fraud. Thirdly, The Bangkok Agreement signed February 4, 2007 presided by FIBA Secretariat through the insensitive Patrick Baumann and witnessed by FIBA-Asia President and Secretary Generalwho stated that the Bangkok Agreement was not followed and respected. Shockingly, that agreement was dishonoured by no less than Borislav Stankovic in July 2009 during the FIBA Special Commission affirming the SBP as the national federation in the Philippines. In fact, the Agreement called for mergers between the BAP and SBP and will have a transitory period of one year where a total number of 87 members will vote for the new set of officers after a year expired. What happened then, SBP manipulated everything with the FIBA consent. Indeed, we the BAP followed and respected the Bangkok Agreement, instead the BAP was the one being punished and kicked out from the FIBA. It’s a horror and another fraud. Imagine, the BAP has been a FIBA member since 1936, and the SBP has never applied for membership with FIBA and what FIBA did was conspired with SBP for the merger. Another FIBA mistake, because under the FIBA General Statute, there will be one national federation per country, and how in the hell did Patrick Baumann insist us to compromise for the merger so that the illegal suspension done by Baumann himself in July 2005 will be lifted, it was blackmail. That was another fraud. Further, we were expecting that there should be a hearing so that clarification of issued in front of the CAS Panel will be more approachable and précised in defending our case, but in the end, the hearing was cancelled instead that CAS Panel will make a decision based on what they perceive to be correct. Patrick Baumann told us in August 2005 to filed a case against the Philippine Olympic Committee (POC) leadership at the CAS, while we are preparing for the case to be filed in coordination with FIBA lead lawyer led by Martens who then recommended a law firm to handled it. Suddenly Baumann signed an agreement with POC when the POC visited him in Geneva. How can Baumann signed a memorandum of understanding indeed the POC was not part of FIBA structure. Worse, the insensitive Baumann himself had earlier investigated in August 2005 that the POC was manoeuvring using political means and the expulsion of BAP as POC member was inappropriate and out of proportion and yet Baumann managed to sign an MOU without the knowledge of BAP. The reason was personal evil scheme of Baumann who wanted badly a vote for his candidacy to IOC as member. This was another personal committed fraud. Lastly, while waiting for the official document from CAS, and after I read the decision then I will make my final resolution on how the decision was done whether in a harsh way, a conspiracy or righteousness. My freedom of expression, right or wrong, I wanted the world to know about the truth. We may file a motion for reconsideration if need be. If we can’t find justice in the CAS, personally, I have put my faith and trust in God’s divine intervention. The truth shall set us free. Sincerely, Graham C. My dear fellow BAP family and friends: A Prosperous New Year to you and your family in Peace! Since the start of the damaging campaign by the POC leadership against the Basketball Association of the Philippines (BAP) in early 2005, the BAP, as a whole, has not given up the fight, except for a few people who turned their backs against the organization to align with the moneyed-manuela. For these Judases, I say good riddance. The BAP is better off without them, much as it allowed us to cleanse our ranks of ill-reputed men and women who do not value principle and honor and share in our vision and mission. There were some familiar names in the national secretariat and regional officer that broke bread with us night in and night out during the good old times, but shamelessly left us in perilous times and moved over to the other side for several pieces of silver. While we try to understand those who might have switched sides in order to have food on their tables, take care of their family’s financial needs and considering the taking advantages of the situation because of personal apprehension only, I cannot but admire the many other people among us who are made of sterner stuff and continue to carry the torch for the BAP despite heavy financial constraints. They are the honorable men and women from the various league-organizations the BAP is very proud of. Money, to them, is not everything. Their principles, after all, do not carry a price. Our struggle for what is right, just and fair in the fight for the local basketball leadership continues to this day. It knows no bounds or limits. Deep in our hearts we know that justice will prevail in the end. I vividly remembered these words of Congressman Luis R. Villafuerte, BAP Chairman, when he was cautioning me, who said: “you will not know the ecstasy of success until you will know the ecstasy of your traitor“. Everybody knows I will never ever give up the fight. That’s because our fight is not guided by material greed but rather it is founded on principles. The people who are trying to destroy the BAP, such as the corrupt and incompetent officials from the Philippine Olympic Committee (POC) and the nondescript so called SBP, simply do not value principles. For them, everything revolves around financial considerations, materialism and just about any Juan can be bought – for a hefty sum. How wrong they are. And I am the living proof of this falsehood. My imprisonment since December 7, 2009 has been traced to the machination of the limp-wrist telecommunication business person, who is well known to buy off influential government officials to get whatever he wants, rightly or wrongly. This gay does not fight on a levelled field, be it in sports or businesses he has engaged in. I pity those officials from the Bureau of Immigration (BI) and Department of Justice (DOJ) officials who have sold their souls to this moneyed-manuela but corrupt businessman in exchange for financial favors or political campaign funds for their greediness and dirty politic convenient. Let it be stated once again, the BAP will not back down from its principled position – that the people who now rule the local basketball leadership are usurpers and lack legitimacy and transparency. Even the Minutes-of-the-Meeting documents pertaining to the Bangkok Agreement that the SBP and co-respondent FIBA submitted to the Court of Arbitration for Sport (CAS) were falsified. Last December 7, 2009, during my attendance at the preliminary investigation proceeding before the Makati City prosecutor’s office after I filed a criminal complaint against the SBP leadership for falsification of the aforesaid minutes-of-meeting document pertaining to the Bangkok Agreement, may have clear connection with my sudden arrest and detention at the Camp Bagong Diwa in Taguig City on that particular day. Late last year, the BAP filed a case against the FIBA in the CAS questioning its affirmation by FIBA of the SBP as the country’s national sports association (NSA) for basketball. This is a very clear violation of the Bangkok Agreement maliciously done by FIBA secretariat in dishonouring its own signature to the said Agreement. The case remains to be solved soon by the CAS. No matter how long it takes, the BAP will continue with its fight for justice. By God’s grace, the battle shall be won, too. For those who continue to believe in this fight, thank you very much. While those who were signatories to the Bangkok Agreement, what is your stand after two years has passed, still undecided and couldn't even knows how to deal with it, just want to make headline like what the FIBA secretariat did attending Unity Congress in the Philippines and witness all the presiding just for the sake of doing something as what the comment made by FIBA Asia last December 2009. I cannot imagine how would these people play their political life to everybody for their own personal interest and good only just for the sake of publicity. I ask what honor of a man doesn't even know how to respect and recognize their own signature and yet they just got away with their greediness and self imposed lord of the darkness invader of privacy like what happened to BAP who has been with FIBA since 1936 and imagine, they affirms SBP as the national federation in the Philippines, can you really imagine that? Wow wow-we, it was really something we can't even illustrate their character what they did to member who has not violated FIBA General Statutes and yet they thought they can just getaway with there mischivious personalities. Look, even a FIBA president will attend the FIBA Asia board and make false statement in front of everybody in the Asia continent, how about that Bob Elphinston (FIBA President) for your liberous reports, do you know what you did in discrediting and damaging the good name and image of the FIBA as an institution with full of negativity as what the comment of FIBA Asia said! My next official letter regarding the FIBA Youth Commission after promising my reinstatement as a gentlemen agreement, still I was ignored, as Patrick Baumann stated a ceasefire expires but they never ever keep their word and so with the ugly's gentlemen agreement term used "that promises are mend to be broken" as it seems like a way of life they are in to.
